The Colombia Solidarity Campaign expresses its maximum concern based on the following information that has just arrived from Colombia:
THE TRADE UNION, HUMAN RIGHTS AND SOCIAL ORGANISATIONS SIGNED BELOW DENOUNCE BEFORE THE NATIONAL AND INTERNATIONAL COMMUNITY THIS NEW AGGRESION AGAINST SINTRAMINERCOL, WE NEED SOLIDARITY IN ORDER TO AVOID IRREPARABLE HARM.
Events
Sunday 2nd May 2004, at 7.30 pm, two explosive devices were detonated in the building belonging to Minercol, at Calle 32 with Carrera 13 in the cente of Bogota, where the headquarters of Sintraminercol the union of workers for the state mining corporation Minercol is located.
The explosive devices were placed in Carrera 13 on the pavement by the Minercol building, on the third floor of which are located the offices of Sintraminercol, and the Workers Cooperative Coominercol the blast shattered Windows and destroyed equipment, files and part of the offices belonging to the Cooperative. It also destroyed offices belonging to the trades unions Asoproteccion Social and Sindiminintrabajo. Neighbouring offices were also affected by the blast.
In spite of the fact that the press has reported it as an attack against the Ministry of Social Protection all the signs indicate that it was directed against the Minercol building. On the first floor are located the Ministry of Social Protections workers Trade union offices, and some offices rented by Minercol to the Ministry of Social Protection, where they can meet with members of the public. It should be noted that a few metres from this buiding is located the CAI building belonging to the National police on Avda 32 between Carreras 7 & 13.
This attack against Sintraminercol has occurred at the same time as the workers are mounting a fight back against the liquidation of Minercol, and the surrendering of mining and petrol resources to the multinationals, and as denouncements by the union, have demonstrated the responsability of the national government and of the multinationals, in the violations of the human rights of workers, small farming communities, afrocolombian communities and the indigneous peoples that inhabit zones rich in natural resources.
Sintraminercol has also denounced the multinationals the Colombian state and the American government for creating paramilitary groups in order to guarantee mining interests, and shown that their lawyers created mining laws, environmental laws, petroleum and telecommunications laws and introduced articles in laws that they have directly benefited from; including the destruction of trade unions belonging to state enterprises, such as Sintraminercol with the liquidation of the state mining company Minercol Ltda. This was done based on article 317 of Law 685 (New Mining Code 2001) and was planned, advised on and regulated by the company lawyers for Holcim, cemex and la Ladrillera Santafe
Coincidentally this attack ocurred the day after a televisión special by ACOTV called World Day of Work, was transmited by the Inravision of Colombia, in which Francisco Ramírez President of Sintraminercol and General Secretary of Funtraenergetica, denounced these events, and the activities of the Colombian labour courts who acting with unusual speed, rushed to lift the legal charters held by Sintraminercol, Sintramin and Sintrcarbon – an indispensable requisite in order to start sacking workers.
Antecedents
On Wednesday 28th April in a public audience convened by the Minister for Mines and Energy, Luis Ernesto Mejia Castro; Trade unionists from USO (oil workers union) and from Sintraminerco protested in order to get their view point heard about the conflicts in the mining and oil sectors, 2 days later Ramiro Luna President of USO Bogota who was the spokesman at the meeting, was sacked.
On Saturday 1st May 2004, 2 men and a women travelling in a white Renault, number plate CBL- 846 of Santafe de Bogota, were watching the union entrance from 9am to 3pm. 1 of the men – a black man wearing a jacket and jeans was watching the union members that participated in the march and in particular Francisco Ramírez President of Sintraminercol. His bodyguards asked a member of the police antiriot squad (ESMAD) to identify the suspects; they established that they were members of ISSPOL, the national police intelligence unit and that they were on an assignment. At approximately 2 pm, 2 taxis arrived each carrying 3 men, and the 3 cars then joined together and waited until the vehicle carrying Francisco Ramírez entered the union headquarters at the 3pm, they then left for an unknown destination.
Throughout 2004 to date, different people have arrived at the union and tried to find Francisco Ramírez, claiming to be displaced people sent by the International Committee of the Red Cross, Students for the human rights committee of the Industrial union of Santander UIS, or simply friends of Francisco that have an appointment with him, information that upon verification proved to be false.
It is worth remembering that the door of this building (Minercol) is where in 1996 Marcia Elina Romero and Manuel Zamora Secretary of the trade union Sintramineralco and Treasurer of Fenasintrap at the time, were held by unidentified organisations and interrogated about the addresses of Francisco Ramírez Cuellar and Jorge Carlos Maria.
Demands
To the National Government
* Take the necessary measures to guarantee the life and physical integrity of Francisco Ramírez Cuellar
* Revoke the liquidation of Minercol
* Stop the persecution of the trade union Sintraminercol
* Order that any action against the life, liberty or integrity of Francisco Ramírez Cuellar be stopped.
* Make a public pronouncement about the need to respect the labour rights and guarantees of the workers and trade unionists in Colombia and the fulfilment of Colombian laws and international norms.
To the Public Prosecutor
* To conduct an exhaustive investigation to the identify, and exemplary charge, those materially and intellectually responsible for the threats, harassment and attacks against Sintraminercol
To the Attorney General
* To investigate the actions of the public employees belonging to the National Police force, the Army and members of the state security organisation whether by action or omission. In regards to the persecution, harassment and attacks against Sintraminercol and its President Francisco Eladio Ramírez Cuellar
Watch over the penal investigations established by Sintraminercol and to take forward with due speed and respect the procedural guarantees necessary to obtain justice.

ATENTADO EN EL CENTRO DE BOGOTA CONTRA LA SEDE DEL SINDICATO NACIONAL MINERO SINTRAMINERCOL
LAS ORGANIZACIONES SINDICALES, DE DERECHOS HUMANOS Y SOCIALES, ABAJO FIRMANTES, DENUNCIAMOS ANTE LA COMUNIDAD NACIONAL E INTERNACIONAL LA NUEVA AGRESIÓN CONTRA SINTRAMINERCOL Y REQUERIMOS SOLIDARIDAD PARA EVITAR DAÑOS IRREPARABLES
HECHOS
A) El día domingo 2 de mayo de 2004 a las 7:30 de la noche dos petardos hicieron explosión en el edificio de Minercol, ubicado en la calle 32 con carrera 13 en el centro de Bogotá, donde está ubicada la sede del sindicato de trabajadores de la empresa Estatal Minera Minercol, SINTRAMINERCOL.
B) Los artefactos explosivos fueron colocados sobre la carrera 13 en el andén del edificio de Minercol, en cuyo tercer piso se encuentran las oficinas de SINTRAMINERCOL y de la Cooperativa de trabajadores COOMINERCOL, causando destrozos en los ventanales y destruyendo algunos equipos, archivos y elementos de las oficinas y de la Cooperativa; también fueron destruidas las oficinas de los sindicatos ASOPROTECCION SOCIAL Y SINDIMININTRABAJO y afectadas algunas oficinas aledañas por efectos de la onda expansiva. A pesar de que los medios masivos de comunicación han presentado estos hechos como un atentado contra el Ministerio de Protección Social, los indicios apuntan a que el atentado iba dirigido contra este edificio, donde en el primer piso se encuentran las oficinas de los Sindicatos de trabajadores del Ministerio de Protección Social y oficinas de atención al público que Minercol tiene arrendadas a este ente estatal.
Llama la atención que a pocos metros de este edificio se encuentra el CAI de la Policía Nacional de la Avda 32 entre las carreras 7 y 13.
C) Este atentado contra SINTRAMINERCOL se da en el Marco de la lucha que trabajadoras y trabajadores vienen desarrollando contra la liquidación de Minercol, la entrega de los recursos mineros y petroleros a las multinacionales y las denuncias que el Sindicato ha realizado demostrando la responsabilidad del gobierno nacional y de las multinacionales en las violaciones a los derechos humanos de trabajadores y comunidades campesinas, afrocolombianas e indígenas que habitan en zonas ricas en recursos naturales.
D) SINTRAMINERCOL, también ha denunciado cómo compañías multinacionales, el Estado colombiano y el gobierno de Estados Unidos han creado grupos paramilitares para "garantizar" la inversión minera; señalando que abogados de estas empresas crearon las leyes de minería, medio ambiente, petróleos y telecomunicaciones e introdujeron artículos que les benefician directamente, acabando sindicatos de empresa, como en el caso de Sintraminercol, pues la liquidación de Minercol Ltda.. se realizó con base en el artículo 317 de la ley 685 de 2001 (nuevo Código de Minas) que fue proyectado, asesorado e incluso reglamentado por abogados de las compañías Holcim, Cemex y Ladrillera Santafé.
E) Coincidencialmente este atentado ocurre al día siguiente del programa de televisión: Especial de ACOTV Día Mundial del Trabajo, transmitido por la programadora INRAVISIÓN Señal Colombia, en el que Francisco Ramírez, presidente de Sintraminercol y secretario general de Funtraenergética, denunciaba estos hechos y en momentos en que se adelanta con celeridad inusual en los juzgados laborales colombianos, el proceso de levantamiento de los fueros sindicales a los directivos de Sintraminercol, Sintramin y Sintracarbón, requisito indispensable para proceder a sus despidos.
ANTECEDENTES
1. El Miércoles 28 de Abril en una Audiencia Pública convocada por el Ministro de Minas y Energía, Luis Ernesto Mejia Castro, sindicalistas de la USO y de SINTRAMINERCOL adelantamos una protesta para que se escucharan nuestros puntos de vista sobre el conflicto minero y petrolero, dos días después fue despedido Ramiro Luna, presidente de la USO Bogotá, quien tomó la vocearía en este acto.
2. El sábado 1 de Mayo/2004 dos hombres y una mujer que se movilizaban en un vehículo Renault color blanco, de placas CBL-846 de Santafé de Bogotá, estuvieron vigilando la entrada al Sindicato desde las 9 a.m. hasta las 3 p.m. Uno de los hombres de tez negra que vestía chaqueta y pantalón de jean estuvo vigilando a los miembros del Sindicato que participaban en la marcha en especial a Francisco Ramírez, presidente de Sintraminercol. Sus escoltas solicitaron a un miembro del escuadrón antimotines de la Policía ESMAD que identificara a los sospechosos, pudiéndose establecer que eran miembros de la SIPOL (Organismo de Inteligencia de la Policía Nacional) y que estaban en cumplimiento de una misión de trabajo. Aproximadamente a las 2 p.m. llegaron dos vehículos (taxis) cada uno con tres hombres en su interior y las personas que se encontraban en los tres vehículos esperaron hasta que el vehículo en que se moviliza Francisco Ramírez entró a la sede del Sindicato a las 3 p.m. y después salieron con rumbo desconocido.
3. En lo que va corrido del año 2004 diferentes personas han llegado hasta el Sindicato y tratado de ubicar a Francisco Ramírez, argumentando ser desplazados enviados por el Comité Internacional de la Cruz Roja (CICR), estudiantes del Comité de derechos humanos de la Universidad Industrial de Santander UIS, o simplemente amigos de Francisco que tienen cita con él, información que al verificarlas resultaron ser falsas.
4. Vale recordar que en la puerta de este edificio fueron detenidos en el año 96, Marcia Elina Romero y Manuel Zamora, secretaria del Sindicato SINTRAMINERALCO y tesorero de Fenasintrap, en esa época, quienes estuvieron por varias horas en poder de organismos no identificados y fueron interrogados para que dieran información relacionada con la residencia de Francisco Ramírez Cuellar y Jorge Carlos María.
SOLICITUDES
Al Gobierno Nacional:
§ Tomar las medidas necesarias para garantizar la vida e integridad física de Francisco Ramírez Cuellar
§ Revocar la liquidación de Minercol
§ Cesar la persecución contra el Sindicato Sintraminercol
§ Ordenar que se detenga cualquier acción que atente contra la vida, libertad e integridad de Francisco Ramírez Cuellar
§ Hacer público un pronunciamiento sobre la imperiosa necesidad del respeto a los derechos y garantías laborales de los trabajadores y sindicalistas en Colombia, en cumplimiento a las leyes colombianas y a las normas internacionales
A la Fiscalia General de la Nación
§ Adelantar una investigación exhaustiva para identificar y castigar ejemplarmente a los responsables materiales e intelectuales de las amenazas, hostigamientos y atentado contra Sintraminercol
A la Procuraduría General de la Nación
§ Investigar la actuación de los funcionarios públicos de la Policía Nacional, Ejército Nacional y miembros de Organismos de Seguridad del Estado en los hechos de persecución, hostigamiento y atentados contra Sintraminercol y su presidente Francisco Ramírez Cuellar, bien sea por acción u omisión.
§ Velar por que las investigaciones penales que ha instaurado Sintraminercol se adelanten con la celeridad necesaria y respeto a las garantías procesales para obtener justicia.
