Urgent Action to protect Venezuelan environmentalist and human rights defender

The Venezuelan Programme for Education and Action in Human Rights (Provea) denounces to the national and international community the threats made against the human rights defender Professor Lusbi Portillo by the President of the State-owned corporation Corpozulia-Carbozulia, Brigade General Carlos Martínez and by the engineer Juan Rojas, an officer of the Venezuelan Government’s Ministry of Energy and Mines.
The Facts
On 8 December 2004, during the discussions of Committee No.2 (on agricultural issues and the struggles of small farmers) of the ‘Bolivarian Congress of Peoples’ held recently in Venezuela, the President of the Venezuelan company responsible for coal extraction in the state of Zulia, Corpozulia-Carbozulia, Brigade General Carlos Martínez publicly made serious accusations against leading ecologists in this frontier state and in particular against human rights defender and ecologist Professor Lusbi Portillo.
General Martínez’ actual words were: “Just as there existed a human rights mafia in Venezuela, environmentalists formed a green mafia. Behind this green mafia, opposed to the exploitation of coal in the Sierra de Perijá, were the counter revolutionaries and the transnational companies, and it was directed by the CIA.” He singled out the human and environmental rights defender Lusbi Portillo for particularly damning criticism, manipulating statements made by Portillo in opposition to coal mining projects in the region and reported in the Zulia state newspaper ‘The Truth’.
Afterwards, on 11 December, a meeting was held involving representatives of Irish coal mining company Brendan Hynes, Corpozulia and the Ministry of Energy and Mines. These people called together the inhabitants of the Parish of Monseñor Godoy in the municipality of Mara in Zulia, to seek the community’s help for the coal mining companies which are going to be exploiting coal in the area at the Socuy and Cachiri mines and the Caño Seco coal deposit. This meeting was chaired by the engineer Juan Rojas, an officer of the Ministry of Energy and Mines (MEM) who is attached to the Ingeominas agency. This officer publicly stated that Professor Lusbi Portillo was ‘a terrorist who robbed MEM of three vehicles in Machiques for financial gain’; later during the event, microphone in hand, he continued making indirect allusions to the presence of Professor Portillo in the meeting.
These remarks endanger the life and integrity of activists in the ecological and human rights movement in Zulia.
Professor Lusbi Portillo is Co-ordinator of the non-governmental organisation ‘Homo et Natura’, dedicated to the defence of the environment. He is a professor of the University of Zulia and an associate member of the Assembly of the Venezuelan Programme for Education and Action in Human Rights (Provea) with a high profile in the movement to defend human rights. The threatening remarks made by General Carlos Martínez and by Juan Rojas become more serious and dangerous if we take into account the fact that they were made in a frontier zone under the influence of Plan Colombia, where guerrilla and paramilitary incursions against the civil population are common and current. It is sufficient to recall the assassination by two hired assassins, still unpunished, of the Co-ordinator of the Vicariate of Human Rights in Machiques, Joe Castillo, on 26 August 2003. Public threats against a leading ecologist with the history and level of public recognition of Professor Lusbi Portillo, committed to the struggles of Indigenous Peoples for their lands and the conservation of the forests and waters of the state of Zulia, constitute a clearly hostile act, intended to instil terror, and this is unacceptable in a democratic society.
Provea condemns these antidemocratic acts on the part of public officials and calls for a public demonstration against them. These acts not only seek to inhibit the activity of communities affected by current and planned mining projects but could be interpreted as a green light to state or private actions which could endanger the life and integrity of Lusbi Portillo and other leaders of the ecological and human rights movements in the Zulia region.
Requests1. That the life and physical and psychological integrity of Professor Lusbi Portillo be guaranteed.
2. Send a letter to the President of the Bolivarian Republic of Venezuela, Hugo Chavez, asking him to investigate the statements made by Brigade General Carlos Martínez and the Ingeominas official, Juan Rojas, confirming the right of individuals and communities to express their criticisms of government projects which damage their human and environmental rights.
3. Send a letter to the Minister of Energy and Mines, Rafael Ramírez, asking him to investigate the statements made by Brigade General Carlos Martínez and the Ingeominas and Minsitry of Energy and Mines official, Juan Rojas.
4. Write to the Defensoría del Pueblo (Human rights ombudsman) to complain about these facts, asking him to issue a public condemnation of the conduct of these government officials and to seek protection for Lusbi Portillo and other activists in the human rights and environmental movements in the state of Zulia.
5. Write to the Fiscalía General (Attorney General’s Office) of the Republic complaining about these facts and asking him to launch an official investigation into the events denounced in this urgent action request.

Dear Mr President,
I am writing to you in this way to express my profound concern about the threats made against human rights defender, Professor Lusbi Portillo, by the President of the state-owned company Corpozulia-Carbozulia, Brigade General Carlos Martinez, and by engineer Juan Rojas, an official of the Ministry of Energy and Mines of the Bolivarian Republic of Venezuela.

At this event, Brigade General Carlos Martínez publicly made serious accusations against leading ecologists in the state of Zulia and in particular against Professor Lusbi Portillo. Afterwards, on 11 December, at a meeting involving representatives of Irish company Brendan Hynes, Corpozulia and the Ministry of Energy and Mine, Juan Rojas stated publicly that Professor Lusbi Portillo was ‘a terrorist who robbed MEM of three vehicles in Machiques for financial gain’. As the event went on, he continued making allusions to the presence of Professor Portillo in the meeting. It is worth adding that Lusbi Portillo has made public his opposition to coal mining projects in a number of statements which have appeared in the local newspaper The Truth.
Lusbi Portillo is the co-ordinator of the non-governmental organization Homo et Natura, dedicated to the defence of the environment. He is a professor of the University of Zulia and an associate member of the Assembly of the Venezuelan Programme for Education and Action in Human Rights (Provea), with a high profile in the human rights movement. The threats and defamatory remarks of which Lusbi Portillo has been made the subject by public officials fill me with a powerful concern for his life and the integrity of his person, and for those of other human rights and environmental activists in Zulia. I consider that these public statements constitute a clearly hostile act intended to instil terror, acts which are unacceptable coming from public officials in a democratic society. At the same time, these actions damage the right to participation in debate by communities affected by current and planned mining projects.
This concern is all the greater because of the possible consequences in an area affected by Plan Colombia, where there are frequent incursions by guerrillas and paramilitaries against the civil population, including the assassination of social leaders and human rights defenders like the Co-ordinator of the Vicariate of Human Rights in Machiques, Joe Castillo, killed by two hired murderers on 26 August 2003.
Because of all these things, I ask you very respectfully to order the establishment of an exhaustive inquirí into the statements made by the named officials and to take steps to protect the life and the physical and psychological integrity of Profesor Lusbi Portillo.
I also ask that the right of individuals and communities to express their criticisms of government projects which might damage their human and environmental rights should be explicitly guaranteed, without them being condemned, attacked or criticised.
Finally, Mr President, I ask that you keep me informed about the situation of Lusbi Portillo and about the result of the investigations and the measures taken in this case.

Provea denuncia ante la comunidad nacional e internacional las amenazas que viene siendo victima el defensor de derechos humanos, Profesor Lusbi Portillo por parte del presidente de la empresa estatal Corpozulia-Carbozulia, General de Brigada Carlos Martínez y también por el ingeniero Juan Rojas, funcionario del Ministerio de Energía y Minas del Gobierno de Venezuela.
Hechos
El día 8 de diciembre del presente año, durante las sesiones de la Mesa No.2 (dedicada al tema agrario y luchas campesinas) del Evento denominado "Congreso Bolivariano de los Pueblos" celebrado recientemente en Venezuela, el presidente de la empresa venezolana para la explotación del carbón en el estado Zulia (Corpozulia-Carbozulia), General de Brigada Carlos Martínez hizo públicas graves acusaciones contra los dirigentes ecologistas del ese estado fronterizo venezolano y particularmente contra el defensor de derechos humanos y ecologista, Profesor Lusbi PORTILLO.
Textualmente dijo el General Martínez lo siguiente: "Que así como existía en Venezuela una mafia de los derechos humanos, los ambientalistas formaban una mafia verde [.] detrás de esta mafia verde contra la explotación del carbón en la sierra de Perijá , estaba la contra revolución y las empresas trasnacionales y que la misma estaba dirigida por la CIA". Particularmente contra el defensor de derechos humanos y ambientales, Lusbi PORTILLO se manifestó en términos descalificadores, en base a la manipulación de declaraciones de Portillo donde expresaba su oposición a los proyectos carboníferos desarrollados en la región, recogidas por el diario "La Verdad" del estado Zulia.
Posteriormente el día 11 de diciembre del año en curso, se realizó una reunión en la que participaron representantes de la empresa carbonífera irlandesa Brendan Hynes, Corpozulia y el Ministerio de Energía y Minas, quienes convocaron a los habitantes de la Parroquia Monseñor Godoy, Municipio Mara, estado Zulia, para solicitar el apoyo de la comunidad a las empresas carboníferas que se van a instalar en esa zona para la explotación del carbón, como son: Mina Socuy, Mina Cachiri y carbonífera Caño Seco. Dicha reunión estuvo dirigida por el ingeniero, Juan Rojas funcionario del Ministerio de Ingeniería y Minas (MEM) adscrito a Ingeominas. Este funcionario afirmó públicamente que el profesor Lusbi PORTILLO "era un terrorista, que en Machiques le había despojado de tres vehículos al MEM y, a él de un dinero"; posteriormente en el transcurso del evento micrófono en mano, continuó haciendo alusiones indirectas a la presencia Profesor PORTILLO en la reunión.
Las amenazas ponen en peligro la vida e integridad de los activistas del movimiento ecológico y de derechos humanos del Zulia.
El profesor Lusbi PORTILLO es coordinador de la organización no gubernamental "Homo et Natura" dedicada a la defensa del medio ambiente, profesor de la Universidad del Zulia y miembro Asociado de la Asamblea del Programa Venezolano de Educación-acción en Derechos Humanos (Provea), con una gran trayectoria en el movimiento de defensa de los derechos humanos. Las amenazas del Gral. Carlos Martínez y del funcionario Juan Rojas se tornan más graves y peligrosas si analizamos que ellas fueron hechas en una zona de frontera bajo la influencia del Plan Colombia, donde son comunes y corrientes las incursiones guerrilleras y de paramilitares contra la población civil. Basta recordar el asesinato aún hoy impune, por parte de dos sicarios, del Coordinador del Vicariato de Derechos Humanos de Machiques, Joe Castillo, el 26 de agosto de 2003. Las amenazas públicas contra un dirigente ecologista de la tradición y reconocimiento social del profesor Lusbi PORTILLO, comprometido con las luchas de los pueblos indígenas por sus tierras, la conservación de los bosques y las aguas del estado Zulia, constituyen una clara acción de hostigamiento y amedrantamiento, inaceptable en una sociedad democrática.
Provea expresa su condena y hace un llamado a manifestarse públicamente en contra de estas conductas antidemocráticas de funcionarios públicos, que no sólo buscan coartar la participación de las comunidades afectadas por los proyectos mineros en curso, sino que pueden ser interpretadas como una luz verde para desatar acciones estatales o privadas que pueden poner en peligro la vida y la integridad de Lusbi PORTILLO y demás dirigentes ecologistas y de derechos humanos de la región zuliana.
Solicitamos
1. Se garantice la vida e integridad física y psicológica del profesor Lusbi PORTILLO.
2. Enviar carta al Presidente de la República Bolivariana de Venezuela, Hugo Chávez Frías, Solicitándole investigar las declaraciones del Gral. de Brigada, Carlos Martínez y del funcionario de Ingeominas, Juan Rojas, ratificando el derecho de las personas y comunidades a expresar sus opiniones críticas sobre proyectos gubernamentales que vulneren sus derechos humanos y ambientales.
3. Enviar carta al Ministro de Energía y Minas Rafael Ramírez, solicitándole investigar las declaraciones del Gral. De Brigada Carlos Martínez, y del funcionario de Ingeominas y del Ministerio de Energía y Minas, Juan Rojas.
4. Enviar comunicación a la Defensoría del Pueblo denunciando estos hechos, solicitándole condene públicamente estas conductas de funcionarios gubernamentales, y que solicite protección para Lusbi Portillo y demás activistas del movimiento de derechos humanos y ambiental del estado Zulia.
5. Enviar comunicación a la Fiscalía General de la Republica denunciando estos hechos, solicitando que investigue de oficio los hechos aquí denunciados.

Señor Presidente: Me dirijo a Usted por este medio para manifestarle mi profunda preocupación por las amenazas de las que fue víctima el defensor de los derechos humanos, profesor Lusbi PORTILLO por parte del presidente de la empresa estatal Corpozulia-Carbozulia, el General de Brigada Carlos Martínez, así como por el Ing. Juan Rojas, funcionario del Ministerio de Energía y Minas del gobierno de la República Bolivariana de Venezuela.
Las amenazas tuvieron lugar el día 08.12.04, durante las sesiones de la Mesa Nº 2 del evento “Congreso Bolivariano de los Pueblos”. En dicho evento el Gral. Carlos Martínez hizo públicas graves acusaciones contra los dirigentes ecologistas del Estado Zulia, y en particular contra el Profesor Lusbi PORTILLO. Concretamente, el Gral. señaló “Que así como existe en Venezuela una mafia de los derechos humanos, los ambientalistas formaban una mafia verde[.] detrás de esa mafia verde contra la explotación del carbón en la sierra de Perijá, está la contrarrevolución y las empresas trasnacionales y la misma está dirigida por la CIA”.
Posteriormente, el 11.12.04, en una reunión donde participaban representantes de la empresa irlandesa Brendan Hynes, Corpozulia y el Ministerio de Energía y Minas (MEM), el funcionario del MEM, Juan Rojas afirmó públicamente que el profesor Lusbi PORTILLO “era un terrorista, que en Machiques le había despojado de tres vehículos al MEM y, a él, de un dinero”. Asimismo, durante el transcurso del evento, siguió haciendo alusiones a la presencia del Profesor PORTILLO en la reunión. Cabe destacar que Lusbi PORTILLO ha hecho pública su oposición a los proyectos carboníferos, en diferentes declaraciones aparecidas en el diario local “La Verdad”.
Lusbi PORTILLO es coordinador de la organización no gubernamental "Homo et Natura", dedicada a la defensa del medio ambiente, es profesor de la Universidad del Zulia y es miembro asociado de la Asamblea del Programa Venezolano de Educación-Acción en Derechos Humanos (Provea), con una gran trayectoria en el movimiento de derechos humanos. Las amenazas y descalificaciones por parte de funcionarios públicos, de las cual ha sido objeto Lusbi PORTILLO, me generan una fuerte preocupación por la vida e integridad de su persona, así como de los activistas del movimiento ecológico y de derechos humanos del Zulia. Considero que estas declaraciones públicas constituyen una clara acción de hostigamiento y amedrentamiento, actos inaceptables viniendo de funcionarios públicos de una sociedad democrática. Asimismo, estas acciones vulneran el derecho a la participación de las comunidades afectadas por proyectos mineros en curso.
Esta preocupación es mayor por las repercusiones en la zona del Plan Colombia; frecuentes incursiones guerrilleras y paramilitares contra la población civil; así como el asesinato de líderes sociales y defensores de derechos humanos, tales como el Coordinador del Vicariato de Derechos Humanos de Machiques, Joe Castillo, el 26.08.03, a manos de dos sicarios.
Por todos estos antecedentes, le solicito, muy respetuosamente se ordene la apertura de una investigación exhaustiva sobre las declaraciones dadas por los funcionarios antes mencionados, y se tomen medidas que garanticen la vida e integridad, tanto física como psicológica del Profesor Lusbi PORTILLO.
Asimismo, solicito sea garantizado, de manera explícita, el derecho de las personas y comunidades a expresar sus opiniones críticas sobre proyectos gubernamentales que puedan vulnerar sus derechos humanos y ambientales, sin que sean censurados, hostigados o criticados por estos hechos.
Por último, le solicito, Sr. Presidente, tenga a bien informarme de la situación de Lusbi PORTILLO, así como del resultado de las investigaciones y medidas que se realicen en torno a este caso.
